Terms of Service

Welcome to Point Pilot ("we", "our", or "the Service"), operated by Pointfolio.co. By downloading, installing, or using the Point Pilot app or website, you agree to these Terms of Service. If you do not agree, please do not use the Service.

1. Description of Service

Point Pilot is a travel rewards management and valuation tool. It helps you track loyalty points, compare miles versus cash, and plan redemptions. Point Pilot does not guarantee airline availability, award space, or redemption success. All valuations and recommendations are estimates based on available data and are provided for informational purposes only. Nothing in the Service constitutes financial, investment, or travel advice.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use the Service. By using Point Pilot you confirm that you meet this requirement. If you are under 18, you should have your parent or guardian's permission.

3. Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Please notify us immediately at info@pointfolio.co if you suspect any unauthorised use of your account.

4. Subscriptions and Billing

Point Pilot offers a free tier and a paid Premium subscription. The following applies to all paid subscriptions:

• Billing. Subscriptions are billed on the cycle shown at the time of purchase (monthly or annual). Your payment method will be charged automatically at the start of each renewal period.
• Auto-renewal. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription at any time through the App Store (iOS), Google Play (Android), or your Stripe billing portal (web).
• Price changes. We may change subscription prices. We will give you reasonable advance notice of any price change. Continued use after the new price takes effect constitutes your acceptance.
• Free trials. If a free trial is offered, you will not be charged until the trial ends. Cancel before the trial ends to avoid being charged.
• Refunds. Purchases made through the Apple App Store or Google Play are subject to the respective platform's refund policy. For web/Stripe purchases, contact us at info@pointfolio.co within 14 days of purchase and we will review your request.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Post or transmit spam, scams, phishing links, malware, or fraudulent content of any kind.
• Post, upload, or share any content that is sexually explicit, pornographic, or that depicts nudity.
• Post, upload, or share any content that sexualises, exploits, or endangers minors in any way. This is an absolute prohibition and will be reported to the relevant authorities.
• Post violent, graphic, hateful, or threatening content, or content that promotes or glorifies harm to any person or group.
• Harass, bully, threaten, or abuse other users.
• Attempt to reverse-engineer, decompile, or extract the source code of the app.
• Use automated tools to scrape, crawl, or otherwise extract data from the Service.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Interfere with or disrupt the integrity or performance of the Service.

We reserve the right to remove content and restrict or terminate access without notice for any violation of these rules.

6. Community Forum

Point Pilot includes a community forum where users may post text, images, and links. You are solely responsible for the content you post. By posting, you grant us a non-exclusive, royalty-free licence to display and distribute that content within the Service.

Prohibited content. In addition to the Acceptable Use rules above, forum posts must not contain:

• Nudity, sexual content, or explicitly violent imagery.
• Any content involving the sexual exploitation or abuse of minors (CSAM). We are legally required to report such content and will do so immediately.
• Links to phishing sites, scam pages, malware, or any site designed to deceive or harm users.
• Misleading financial advice, pump-and-dump promotions, or affiliate spam.

Automated moderation. All posts and images are automatically scanned using Google Cloud Vision SafeSearch and Google Safe Browsing. Content flagged as harmful is blocked before it becomes visible to other users. Automated moderation is not a substitute for human review. We also review reported content manually.

Reporting. If you see content that violates these rules, use the in-app report button on the post. We aim to review reports within 48 hours.

Consequences. Violations may result in content removal, temporary suspension, or permanent account termination, depending on severity. Illegal content, including CSAM, will be reported to law enforcement and, where required, to the National Center for Missing & Exploited Children (NCMEC) or equivalent authority.

7. Intellectual Property

All content, features, and functionality of Point Pilot, including the app, website, logo, data, and text, are owned by Pointfolio.co and protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written consent.

8. Data Collection and Privacy

By using the Service, you consent to our data practices as described in our Privacy Policy. We collect account data via Firebase and process payments via Stripe. We do not sell your personal information.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Loyalty program data, valuations, and transfer partner information may not always be current or accurate.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Pointfolio.co shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Our total liability to you for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or €10, whichever is greater.

11. Termination

You may stop using the Service and delete your account at any time through the app's Settings screen. We may suspend or terminate your access at any time if we reasonably believe you have violated these Terms, without prior notice and without liability to you. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including Sections 7, 9, 10, 12, and 13) will continue to apply.

12. Changes to These Terms

We may update these Terms from time to time. We will post the revised version on this page and update the "Last updated" date. For material changes, we will notify you via the app or by email. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of Ireland, without regard to its conflict of laws principles. Any dispute arising from or related to these Terms or the Service shall first be attempted to be resolved informally by contacting us at info@pointfolio.co. If the dispute cannot be resolved informally within 30 days, it shall be subject to the exclusive jurisdiction of the courts of Ireland, unless mandatory consumer protection laws in your country of residence provide otherwise.
